DISTINGUISHING FEATURES OF THE CLASS

Under general supervision, an employee in this class reviews inspection records to ascertain that sufficient evidence exists to proceed with an informal hearing for violations of the Suffolk County Sanitary Code.  The purposes of the hearing are to obtain industry's compliance with the Code and to levy penalties.  The work is per­formed under rules promulgated by the Suffolk County Department of Health Services as the agent of the New York State Department of Environmental Conservation.  This class is distinguished from Public Health Sanitarian in that the employee conducts viola­tion hearings, reviews testimony and evidence, and drafts legal documents.  Work is reviewed by an administrative superior through recommendations, reports and con­ferences.  Does related work as required.

 

TYPICAL WORK ACTIVITIES

          Reviews case violations of environmental air and water pollution for legal hearings;

          Participates in preliminary hearings at which legally binding agreements are secured;

          Drafts "consent order" agreements for voluntary compliance by firms with County and State environmental laws;

          Recommends penalties based on severity of violation;

          Refers cases where no consent decree has resulted from preliminary hearing to District Attorney or regional Office of Environmental Conservation;

          Requests warrant of access from judge to search premises;

          Mediates with industry attorneys and engineers or other representatives;

          Suggests corrective measures industry can take to remove violations;

          Participates at formal hearings as spokesperson for Health Services and prepares summations for guidance of the department;

          May assist in drafting departmental environmental enforcement bulletins.

 

FULL PERFORMANCE KNOWLEDGES, SKILLS, ABILITIES AND PERSONAL CHARACTERISTICS

Thorough knowledge of the principles, laws, regulations and techniques of environmental sanitation and enforcement; thorough knowledge of methods used in investigations; good knowledge of the Suffolk County Sanitary Code and New York State Department of Environmental Conservation regulations; ability to prepare legal drafts, including consent orders and warrants of access; ability to conduct preliminary hearings with owners and managers of business establishments or their attorneys and representatives; ability to assess fines according to severity of violations; ability to render legal decisions regarding violations; good judgment; physical condition com- mensurate with the demands of the position.

 

MINIMUM QUALIFICATIONS

          PROMOTIONAL

          Two years permanent competitive status as a Senior Public Health Sanitarian.
