DISTINGUISHING FEATURES OF THE CLASS

An employee in this class participates in the review, research and prepara­tion of opinions and reports on substantive and procedural questions of law.  The incumbent may prepare background material for administrative or court action, but would not appear in court to argue motions or conduct a trial on behalf of the department, as this is a function of the office of the County or Town Attorney.  Work is reviewed in progress and upon completion by the depart­mental attorney or administrative supervisor, through conferences and written reports.  Does related work as required.  

 

TYPICAL WORK ACTIVITIES

          Performs research and prepares opinions on points of law, interpretations, precedents and other background material for the guidance of the department; 

          Reviews cases of possible violations of law or departmental regulations to determine appropriate administrative or legal action; 

          Compiles information and case material in preparation for administrative or court proceedings involving the department; 

          Prepares official legal documents, such as petitions, motions and orders, required in court actions; 

          Participates in the negotiation and preparation of contracts with author­ized individuals or agencies performing services for the department; 

          May assist in drafting departmental regulations and policy, and charter amendments or legislation relevant to the department. 

 

FULL PERFORMANCE KNOWLEDGES, SKILLS, ABILITIES AND PERSONAL CHARACTERISTICS

Good knowledge of Federal, New York State and local laws affecting the operation of the department; good knowledge of legal terminology and format of documents used in court actions; good knowledge of legal procedures as they apply to the operations of the department; ability to apply legal training to specific issues and cases affecting the department; ability to gather, organize and evaluate material relevant to legal actions; ability to prepare clear and concise legal opinions based on research and knowledge of the law; physical condition commensurate with the demands of the position. 

 

MINIMUM QUALIFICATIONS

          OPEN COMPETITIVE

          Graduation from an accredited law school.
