DISTINGUISHING FEATURES OF THE CLASS
An employee in this class participates
in the review, research and preparation of opinions and reports on substantive
and procedural questions of law for the Suffolk County Department of Law. The
incumbent may prepare background material for administrative or court action
and may appear in court to argue motions in various trial courts or conduct a
trial on behalf of the department in courts other than Supreme Court. In the assignment of duties, the County
Attorney may be guided by the individual's ability, experience and background,
as well as the availability of personnel.
Direction is received from high-level professional personnel who review
work through reports and conferences.
Does related work as required.
TYPICAL WORK ACTIVITIES
Performs
research and prepares opinions on points of law, interpretations, precedents,
and other background material for the guidance of the department;
Tries
cases in New York State and Federal Courts;
Reviews
cases of possible violations of law or departmental regulations of other County
departments to determine appropriate administrative or legal action;
Compiles
information and case material in preparation for administrative or court
proceedings involving other County departments;
Prepares
official legal documents, such as Petitions, Motions and Orders required in
court actions;
Participates
in the negotiation and preparation of contracts with authorized individuals or
agencies performing services for the County;
May
assist in drafting regulations, policy statements and Charter amendments or
legislation relevant to other County departments.
FULL PERFORMANCE KNOWLEDGES, SKILLS,
ABILITIES AND PERSONAL CHARACTERISTICS
Good knowledge of Federal, New York
State and local laws affecting the operation of the department; good knowledge
of legal terminology and format of documents used in court actions; ability to
apply legal training to specific issues and cases affecting the County; ability
to gather, organize and evaluate material relevant to legal actions; ability to
prepare clear and concise legal opinions based on research and knowledge of the
law; ability to express oneself clearly both orally and in writing; good judgment;
physical condition commensurate with the demands of the position.
MINIMUM QUALIFICATIONS
This position is in the exempt class;
therefore, there are no minimum qualifications.
Possession of a New York State license to practice law
before the Bar of the State of New York, and, depending on assignment,
eligibility to be qualified to practice before district, state, and/or family
courts.
At the time of appointment and during employment the
employee must possess a valid license to operate a motor vehicle in New York
State.
